Terms of service

§ 1 Scope

(1) These Terms and Conditions apply to all contracts concluded via the online shop shop.jkonradschmidt.com between J. Konrad Schmidt, Regensburger Str. 9, 10777 Berlin, Germany (“we”, “us”) and our customers (“you”).

(2) A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession (Section 13 BGB). An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their trade, business or profession (Section 14 BGB).

(3) Deviating terms of entrepreneurs do not apply unless we expressly agree to them.

§ 2 Conclusion of the contract

(1) The presentation of products in our online shop does not constitute a legally binding offer, but an invitation to place an order.

(2) You can place an order as follows: select the desired item and add it to the cart; open the cart and proceed to checkout; enter your email address, billing and delivery address; select the shipping method and payment method; review all details on the final checkout page; then click the order button that completes the purchase with an obligation to pay. By clicking this button, you submit a binding offer to purchase the items in your cart. For some payment methods (e.g. PayPal), you will be redirected to the payment provider to authorise the payment as part of this process.

(3) Until you click the order button, you can correct your entries at any time: you can change quantities or remove items in the cart, and you can edit your contact, address, shipping and payment details in the respective checkout step or return to previous steps using the browser’s back button or the links in the checkout.

(4) Immediately after receiving your order, we send you an order confirmation by email. The contract is concluded when this order confirmation is sent.

(5) The contract language is English. Our cancellation policy is additionally provided in German.

(6) We store the contract text. We send you the order details, these Terms and Conditions and the cancellation policy with the order confirmation by email. You can view and print these Terms and Conditions on this page at any time. If you have a customer account, you can also view your past orders there.

§ 3 Prices and shipping costs

(1) All prices include statutory value added tax where applicable.

(2) In addition to the prices, shipping costs are charged. They depend on the delivery country and the weight of the order and are shown in our shipping information and in the checkout before you place your order.

(3) For deliveries to countries outside the European Union, customs duties, import taxes and fees may be charged by the authorities of the destination country or by the carrier. These are not included in our prices and must be borne by you.

(4) If you select a currency other than the euro, prices are displayed and charged in the selected currency as shown in the checkout.

§ 4 Personal dedications

(1) On request, J. Konrad Schmidt will add a handwritten personal dedication to your book. Please enter the desired wording in the field “Order special instructions” in the cart before placing your order.

(2) A book with a personal dedication is produced according to your individual specification and clearly tailored to your personal needs. For such books, there is no right of withdrawal (Section 312g(2) no. 1 BGB; see our cancellation policy). Your statutory warranty rights remain unaffected.

§ 5 Payment

(1) The available payment methods are shown in the checkout. Depending on the delivery country, these may include credit and debit cards, Apple Pay, Google Pay, Shop Pay, Klarna, PayPal and other local payment methods.

(2) Unless otherwise stated for the payment method you choose, the purchase price is due upon conclusion of the contract. For Klarna and PayPal payment methods, the terms of the respective payment provider additionally apply, which you will be shown when selecting the payment method.

§ 6 Delivery

(1) We deliver to the countries listed in our shipping information.

(2) Delivery times are stated in our shipping information. For advance payment methods, the delivery time begins on the day after we receive payment; for purchase on account or instalments (Klarna), on the day after conclusion of the contract. If the last day of the delivery time falls on a Saturday, Sunday or public holiday at the place of delivery, the next working day is decisive.

(3) If you are a consumer, the risk of accidental loss or deterioration of the goods passes to you only when the goods are handed over to you. If you are an entrepreneur, the risk passes to you when we hand the goods over to the carrier.

§ 7 Retention of title

The goods remain our property until full payment of the purchase price.

§ 8 Right of withdrawal

Consumers have a statutory right of withdrawal. Details are set out in our cancellation policy. You can withdraw from the contract online using the button “Withdraw from contract” on our website.

§ 9 Warranty

(1) The statutory warranty rights (liability for defects) apply. Information on the legal guarantee of conformity under EU law can be found at europa.eu/youreurope/guarantees.

(2) If goods are delivered with obvious transport damage, please report this to the carrier and contact us as soon as possible. Failure to do so has no effect on your statutory rights; it helps us to assert our own claims against the carrier.

§ 10 Liability

(1) We are liable without limitation for damages resulting from injury to life, body or health, for damages caused intentionally or by gross negligence, under the German Product Liability Act, and to the extent that we have given a guarantee or fraudulently concealed a defect.

(2) In the case of slight negligence, we are only liable for the breach of essential contractual obligations, i.e. obligations whose fulfilment is essential for the proper performance of the contract and on whose fulfilment you may regularly rely (e.g. delivery of the goods free from defects and on time). In this case, our liability is limited to the foreseeable damage typical for this type of contract.

(3) Otherwise, our liability is excluded. The above provisions also apply in favour of our vicarious agents.

§ 11 Governing law and place of jurisdiction

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, this choice of law does not deprive you of the protection afforded to you by the mandatory provisions of the law of the country in which you have your habitual residence.

(2) If you are a merchant (Kaufmann), a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contracts with us is Berlin.
